LEGAL REQUIREMENTS FOR WILLS IN NEW YORK

A will (in the Law called a "Last Will and Testament") is only valid if all of the statutory requirements are strictly satisfied. These requirements include signing by the testator (person making the will), signature or "acknowledgment" in the presence of two attesting witnesses, and what is called "publication" of the will.  Although the vast majority of wills are uncontested, there have been unfortunate cases where a will was declared null and void because of some technical violation of one or more provisions of the wills statute. This is why you should have your will prepared by a New York wills lawyer who knows and understands the laws.
The complexity of your New York will is based largely on the assets in your estate. A lawyer drafting a will for large estates must consider Federal and New York Estate and Gift Taxes. Smaller estates can benefit from a simple will depending on how you want the assets distributed.

You may be hesitant about spending thousands of dollars in legal fees for a simple will. On the other hand, you may be even more apprehensive about the various "do it yourself" services and kits. These services do not include speaking with a lawyer or having your will reviewed by one to be certain it is a valid, legal document.

Fortunately, there is a third option. Mr. Matthews, a New York wills attorney offers a simple will at a very reasonable fee. Best of all, you do not have to travel to Mr. Matthews' offices. Everything is done by phone and email.
